Which requirements should foreigners meet to rent a house in Vietnam

According to Article 119 and Article 149 of the Housing Law of Vietnam, and Article 3 of the Law on Entry, Exit, Transit, and Residence of Foreigners in Vietnam, foreigners can rent a house in Vietnam if they meet the following conditions:

  • They must have full capacity for civil acts to conduct housing transactions.
  • They possess a passport or valid international travel document and visa as regulated by the Law on Entry, Exit, Transit, and Residence of Foreigners in Vietnam.
  • It is not mandatory to have temporary or permanent residence registration at the place where the housing transaction occurs.

Essential Payments and Terms when renting houses/ apartments in Vietnam

When signing a lease agreement, the tenant should prepare the following upfront

  • Deposit: Typically equivalent to 2 months’ rent. The tenant pays the rental deposit to the landlord as a commitment to fulfill the lease terms. If the tenant follows the terms and maintains the property, the landlord refunds the deposit at the end of the contract.
  •  Rent: After signing the lease, foreign tenants shall pay one month’s rent to the landlord. Subsequently, on the same date of each month, the tenant pays the same amount to the landlord.

Other fees: Tenants typically pay management and utility bills monthly after the first month.

Rental period: Most contracts are for 1 year, but there are cases where contracts are for 2 years or more. However, landlords often do not prefer contracts of less than one year, so it is difficult to conclude them.

Payment methods: Payments can be made in cash or transferred electronically to the landlord.

Steps to follow before, during, and after renting houses/apartments in Vietnam

  • Find an apartment that fits your criteria: You give your real estate agent the necessary information (budget, move-in date, etc.), and the real estate agent shows you apartments that are currently for sale. We recommend that you start looking for a place about a month to a month and a half before your intended move-in date.
  • Before handover: Once you find a house you like, tenants should verify the legal status of the apartment before signing the lease agreement and receiving the apartment; carefully review the lease contract and inspect and document the condition of the apartment (furniture, appliances, electrical system, lighting, etc.) prior to handover, allowing the landlord to quickly address any repairs in order to avoid any damage in the house upon move-out.
  • During the tenancy: Besides the rent, tenants may also pay for monthly apartment management fees, utility costs (such as electricity and water), internet charges, and maintenance fees for air conditioning (AC) every 3-6 months, etc.
  • Terminate the lease: After finishing the lease agreement without desire for renewal, tenants should hire a cleaning service to ensure they leave the apartment in a clean condition and return to its original state for the landlord. Apart from normal wear and tear, any damages caused by the tenant’s negligence shall be repaired to its original condition by the tenant, or the landlord may deduct repair costs from the security deposit before refunding it to the tenant.

Notes when renting houses/ apartments in Vietnam

  • Inspect the apartment status before renting: After the tenant signs the lease and acknowledges the apartment’s condition, they are responsible for any unusual damages that occur. Therefore, tenants should check and agree on the apartment’s condition with the landlord
  • Check the living environment and nearby amenities: Consider the sound environment, air quality, and surrounding landscape when deciding to rent an apartment, as these factors will directly affect your quality of life. Additionally, amenities such as stores, shopping stores, and the apartment’s connectivity are bonuses when renting.
  • Temporary residence registration: According to Vietnam’s 2020 Residence Law, foreigners must register their temporary residence within 24 hours of arriving at their apartment. Foreigners can register online at https://hochiminh.xuatnhapcanh.gov.vn/ (in case you stay in HCMC) or offline at the local police station. Therefore, you shall be clear about this with the landlord. Usually, the landlord will register the temporary residence for the tenant.
